Policies, Love Them, Hate Them Part 3, Harassment and Discrimination

It is essential for companies to have harassment and discrimination policies in writing. The policy must describe the procedure for filing a complaint relating to perceived harassment or discrimination. At a minimum, the policy should state the kind of conduct that is prohibited, that the described conduct is a violation of state and federal law, and that the company will take appropriate measures to investigate complaints and redress any harm done. The policy must also state that retaliation is strictly prohibited and will not be tolerated. The policy should be distributed to all employees and the distribution acknowledged is some traceable way. Additionally, the policy should be posted in a visible place. For more information on California law and for downloadable posters go to www.DFEH.ca.gov, for federal law go to www.EEOC.gov.

As a side note, if you are a California company with more than 50 employees you must train your managers/supervisors on sexual harassment. I will provide more information on training in a separate post.
