Proactive vs. Reactive Legal Advice – The Difference may be Personal Liability

The General Counsel is committed to serving businesses that recognize the value in preventing legal difficulties up front, rather than resolving them after they have arisen. The officers of many fast-growth companies choose to deal reactively with legal issues which increase the risk and likelihood of incurring company liability and the payment of large outside law firm bills.  According to the In-house Blog, now officers have even more reason to be proactive with their handling of legal matters than just the risk of liability and legal cost to the company – corporate officers can now be held liable for IP infringement by the company.   The officers of that company could have used the proactive advice of an experienced in-house general counsel.
